AUSTRALIAN PARTNER/PARENT/CHILD VISAS

PARTNER VISA STREAM

​

Through the Partner Visa Stream an applicant can be sponsored by their Australian spouse, de facto or interdependent partner who must be either an Australian citizen, Australian permanent resident or an eligible New Zealand citizen, aged over 18 years.

Partner Visa (820/801)

If you are onshore, Visa Subclass 820 visa would be of suitability. To be eligible, you need to be  in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. The visa allows you to live and work in Australia while awaiting for a permanent (801) visa decision.

Prospective Marriage Visa (300)

If you are offshore and engaged to an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, you can apply for visa subclass 300 which allows you to legally enter Australia to marry your fiancé. Upon marriage, you are eligible to apply for a subclass 820/801 Partner visa.

Partner Visa (309/100)

If you are offshore and in a de facto relationship with or married to an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, applying for visa subclass 309/100 allows you to legally enter Australia to be with your partner and permits you to live, study, work, and travel without any limitations.

 

PARENT VISA STREAM

There are various types of Parent Visas applicable on their locations.

The Applicant must have an eligible child who is a settled Australian citizen, Permanent resident or Eligible New Zealand citizen, meet the balance-of-family test, have an Assurance of Support and not have already applied for or hold a Sponsored Parent (Temporary) (subclass 870) visa when applying for this visa.

For Parents applying outside Australia, there are the following visas:

1. Parent Visa (Subclass 103);

This is the permanent Parent visa. It allows a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen to move to Australia permanently.

2. Contributory Parent (Temporary) Visa (Subclass 173);

This is the temporary version of the Contributory Parent visa that you apply for from outside Australia. It allows a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen to stay in Australia for two years. At the end of this period, you can transition to a permanent Subclass 143 visa. The current waiting time for this visa is between 5 and 6 years.

You can spread the cost of the permanent visa over a number of years by applying in 2 steps:

First, apply for the temporary Contributory Parent (Temporary) (subclass 173) visa, transition to the permanent Contributory Parent (subclass 143) visa.

3. Contributory Parent (Resident) Visa (Subclass 143).

This is the permanent version of the Contributory Parent visa. It allows a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen to move to Australia permanently. You can apply for this visa from inside our outside Australia.

For Parents applying inside Australia, there are the following visas:

1. Aged Parent Visa (Subclass 804);

This is the permanent Aged Parent visa. It allows a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen to move to Australia permanently. You must be over 67 years old and be in Australia when you apply.

The current waiting time for this visa is around 30 years.

2. Contributory Parent (Resident) Visa (Subclass 143);

This is the permanent version of the Contributory Parent visa. It allows a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen to move to Australia permanently. You can apply for this visa from inside our outside Australia.

3. Contributory Aged Parent (Temporary) Visa (Subclass 884);

This is the temporary version of the Contributory Aged Parent visa for people who in Australia and over 67 years old. It allows a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen to stay temporarily in Australia for two years. At the end of this period, you can transition to a permanent Subclass 864 visa.

4. Contributory Aged Parent (Resident) Visa (Subclass 864).

You can apply for the permanent subclass 864 visa as a two-step process by first applying for a Contributory Aged Parent (Temporary) Subclass 884 visa. Applying for the Subclass 884 visa and then the Subclass 864 visa allows you to spread the cost of the visas over a number of years.
